Terms & Conditions – UrgenTTradie

1. About UrgentTradie

UrgentTradie (ABN XX XXX XXX XXX) operates an online platform at urgenttradie.com.au that connects customers who need urgent trade services with independent, qualified tradespeople ("Tradies") across the Sydney metropolitan area.

UrgentTradie is a marketplace and booking facilitator only. We do not perform any trade work ourselves, and we are not a party to any agreement between a customer and a tradie.

2. Acceptance of terms

By accessing or using the UrgentTradie platform, you agree to be bound by these Terms and Conditions. If you do not agree, you must not use the platform.

These terms apply to all users, including customers submitting job requests and tradies receiving and responding to those requests.

3. The platform

UrgentTradie provides a technology platform that:

Allows customers to submit requests describing urgent trade service needs
Broadcasts those requests to multiple qualified tradies in the customer's area
Enables tradies to respond with availability and pricing
Allows customers to compare, select and book a tradie

We do not guarantee the availability, quality, safety, or legality of services offered by tradies on the platform. We do not endorse any particular tradie, and any ratings or reviews displayed are provided by other users.

4. Customer obligations

As a customer, you agree to:

Provide accurate and truthful information when submitting a job request
Provide a valid phone number and respond to tradies in a timely manner
Not submit fraudulent, misleading or spam requests
Pay the tradie directly for any work performed at the agreed price
Treat tradies with respect and provide safe access to the work site

5. Tradie obligations

As a tradie registered on the platform, you agree to:

Hold all required licences, permits and qualifications for the trade work you perform in New South Wales
Maintain current public liability insurance of at least $10 million
Provide accurate business and contact information
Respond to customer requests promptly and professionally
Provide fair and transparent pricing
Comply with all applicable Australian laws, including the Home Building Act 1989 (NSW) where applicable
Not contact customers obtained through the platform for purposes unrelated to the original job request

6. Fees and payment

For customers: The UrgentTradie platform is 100% free to use. There are no booking fees, service charges or commissions payable by customers. You only pay the tradie directly for work performed.

For tradies: Tradies may be charged a lead fee or subscription fee to receive and respond to customer requests. Fee structures are outlined in the separate Tradie Partner Agreement provided upon registration. UrgentTradie reserves the right to change its fee structure with 30 days' written notice.

7. Intellectual property

All content on the UrgentTradie platform, including text, graphics, logos, icons, images, software and design, is the property of UrgentTradie or its licensors and is protected by Australian and international intellectual property laws.

You may not reproduce, distribute, modify or create derivative works from any content on the platform without our prior written consent.

8. Limitation of liability

To the maximum extent permitted by law, UrgentTradie excludes all liability for:

The quality, safety, legality or timeliness of trade services performed by tradies
Any damage to property or personal injury arising from trade work
Any dispute between a customer and a tradie
Loss of data, revenue, profits or any indirect or consequential loss
Platform downtime, errors or interruptions

UrgentTradie's maximum aggregate liability to you for any claim arising from or related to the platform is limited to AUD $100.

9. Indemnity

You agree to indemnify and hold harmless UrgentTradie, its directors, officers, employees and agents from any claim, loss, damage, cost or expense (including legal fees) arising from your use of the platform, your breach of these terms, or your negligence or wilful misconduct.

10. Termination

UrgentTradie may suspend or terminate your access to the platform at any time, without notice, if we reasonably believe you have breached these terms or engaged in conduct that is harmful to other users or to UrgentTradie.

You may stop using the platform at any time. For tradies, termination of your account is subject to the terms of the Tradie Partner Agreement.

11. Dispute resolution

If a dispute arises between you and UrgentTradie, we encourage you to contact us first at hello@urgenttradie.com.au so we can attempt to resolve it informally.

If informal resolution is not possible, disputes will be resolved by mediation administered by the Australian Disputes Centre (ADC) in Sydney before either party may commence court proceedings (except for urgent interlocutory relief).

For disputes between customers and tradies, UrgentTradie is not a party and has no obligation to mediate. You may contact NSW Fair Trading or your state consumer protection agency.

12. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted or modified by agreement.

To the extent that our liability cannot be excluded, it is limited (at our option) to supplying the services again or paying the cost of having the services supplied again.

13. Governing law

These terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts which may hear appeals from those courts.

14. Changes to these terms

We may update these terms from time to time. Material changes will be communicated by posting a notice on the platform or by email. Your continued use of the platform after changes take effect constitutes acceptance of the updated terms.
